By accessing or using Inside Pitch (the "Service"), operated at insidepitch.ai, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. "You" refers to any individual or entity accessing the Service.

2. Description of Service

Inside Pitch is an AI-powered platform that matches journalists with expert sources. The platform is currently in a pre-launch phase. Access is available through a waitlist. Features, availability, and functionality may change without notice as we develop the product.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and that the information you provide is accurate and complete.

4. User Accounts and Waitlist

When you join the waitlist or create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of any account credentials. Joining the waitlist does not guarantee access to the Service or any particular features.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to send unsolicited communications, spam, or bulk messages
• Scrape, crawl, or use automated means to access the Service without written permission
• Interfere with or disrupt the integrity or performance of the Service
• Use information obtained through the Service to harass, abuse, or harm others

6. Pre-Populated Source Database

Inside Pitch maintains a database of expert source profiles compiled from publicly available information, including press releases, podcast appearances, conference proceedings, and other public records. If you are listed in our database:

• Your profile is based solely on publicly available information
• You may claim and enrich your profile at any time
• You may opt out and request removal of your profile at any time by contacting us
• We make reasonable efforts to ensure accuracy but do not guarantee the completeness or correctness of any profile

7. Intellectual Property

The Service, including its design, text, graphics, logos, icons, software, and all other content, is the property of Inside Pitch and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the Service without our written consent.

"Inside Pitch" and associated logos are trademarks of Inside Pitch. You may not use our trademarks without prior written permission.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We make no warranties regarding the accuracy, reliability, or completeness of any information provided through the Service, including expert source profiles and AI-generated matches.

Inside Pitch does not verify the credentials, qualifications, or representations of any expert sources listed on the platform. Users are responsible for independently verifying any information obtained through the Service.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Inside Pitch and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of or inability to use the Service, regardless of the theory of liability.

Our total aggregate liability for all claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Inside Pitch and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Termination

We may suspend or terminate your access to the Service at any time, for any reason, without prior notice. You may stop using the Service at any time. Upon termination, provisions of these Terms that by their nature should survive will remain in effect.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms. If you disagree with the changes, you should discontinue use of the Service.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
